PURCHASING TERMS AND CONDITIONS

Purchasing terms, conditions, general, returns, warrantee, legal, shipping, damage, arbitration, and more are hereafter referred to as “TERMS”. It is your responsibility to read these TERMS before using the website to place an order. To complete your order for a LABOOMA SKI BOX you must acknowledge you have read, understand, and accept all TERMS. Your acceptance is deemed automatic when the order is placed.

When the word “US” is used in these TERMS, it refers to LLTEK MOTORSPORTS CORP, the provider of the LABOOMA SKI BOX.

There are 3 registered international patents related to the design and functionality of the LABOOMA ski box which will be defended vigorously if needed.

The TERMS listed and detailed below are very important to you and we ask you to please read them carefully.

Section 1 - General

The ski box when packed for shipping is physically large, reasonably heavy, and an awkward shape. If returned to US under our guidelines it creates an ongoing financial obligation on your part. Make a good decision when placing your order so a return will not be necessary. We want you to enjoy the box design, its fuel savings and to appreciate its low aero profile creating low air resistance.

Section 2 - Returns

You can only return the LABOOMA SKI BOX to US under the following conditions. We view a return as an unusual event, and we prefer you make a good purchasing decision, so a return is unnecessary. Note: Once an order is shipped it cannot be recalled.

  1. To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.
  2. The box must leave your residence/business precisely within 10 calendar days after its receipt. If you are after 10 calendar days, any return will not be accepted. We will have on record the date and exact time of receipt from the transport company.
  3. You have not installed the box on your car or any other vehicle.
  4. All parts, including documentation, must be returned at the same time and must be in new and unused condition.
  5. If you have unpacked the box, you must repack it in the same way as it was packed and shipped to you.
  6. The outer clear protective plastic covering the ABS structure of the LABOOMA SKI BOX must be in place as when it was shipped to you.
  7. You must reuse the original cardboard shipping box, or you must use a similarly secure alternative.
  8. You must insure the return shipment for the full value of the original purchase. If there is any damage to the LABOOMA SKI BOX during the return, it is your responsibility to make a claim with your transport company. No refund will be made on any return if the return arrives damaged.
  9. You must remove all outbound labels that are on the original shipping box to you, should you choose to use it for a return.
  10. Transportation time to us is not included in the 10-day calendar window.
  11. You must choose a transportation company who can make delivery to our door within 12 calendar days.
  12. To know who you are, you must include your account document file in the box. Without this information no credit will be authorized.
  13. You will be responsible for all return shipping costs to US.
  14. Should you return the box, for any reason whatsoever, you will be charged a 30% restocking fee of the original LABOOMA SKI BOX purchase price, which will be automatically deducted from any refund.
  15. During delivery, if a shipment is refused and is returned to US, the restocking fee automatically doubles to 60%, and all other conditions of a return remain.
  16. You will be responsible for any and all inbound duties, taxes, and related charges should there be any, and these costs will be deducted from any refund.
  17. You will pay a $40 new cardboard box fee, and this amount will be deducted from any refund.
  18. You will not receive a credit from US for outbound shipping and the amount of $350 will be used to represent this subsidized shipping cost, and this amount will be deducted from any refund.
  19. You will be sent an email of all charges showing you how your net refund was calculated in accordance with the TERMS.

  21. You must choose a responsible freight shipping company and forward to us a Tracking Number by email.
  22. Once we receive your return box and contents, it will be evaluated and only if “like new” will any refund be processed.
  23. If a refund is approved, you’ll be refunded on your original payment method within 10 business days after we receive your return. Please note that it can take some time for your bank or credit card company to process and post the refund. This delay is from your bank and not us, and can take up to an additional 5 or more business days.
  24. Credits will only be processed back to the original credit card used for the purchase.
  25. If you meet all the above criteria your credit will be processed approximately within 5 days.

Section 3 - Shipping

As previously stated above, the ski box, when packed for shipping, is physically large, reasonably heavy, and awkward. When the box arrives in your area you may be called by the shipping company to arrange for final delivery at a time that is convenient for you and them. Note the following:

  • You or your adult representative must be on hand when the box arrives, and it must be a safe and secure receiving point.
  • If you delay the delivery for any reason, you may incur additional storage fees charged by the delivery carrier for which you are solely responsible. If for any reason we incur any charges related to any delay in delivery, you authorize us to charge your credit card automatically for these charges.
  • You must assist the shipping company driver with unloading.
  • The shipping company’s sole obligation is to make delivery at the edge of your property or in a driveway and is dependent on their truck size. (Defined as curbside delivery by the carrier).
  • Should you not be available during the unloading, and if extra delivery costs are created, you will be charged for these costs, and it is your obligation to pay these costs. If for any reason we incur any charges related to any additional costs associated with the delivery, you authorize us to charge your credit card automatically for these charges.
  • Shipping will only be to residential homes or commercial establishments. We will not ship to a Post Office Box or to Military bases (APO).

Section 4 - Damage visible during delivery

Our outer delivery box is extra strong, and all interior contents are well protected. That said it is possible that you may see some serious outer box damage when the carton is unloaded from the transport truck. In this case take photos for documentation and open the cardboard box to see if there is transferred damage to the LABOOMA SKI BOX. Your LABOOMA SKI BOX is made from high quality 5mm thick ABS plastic and there should be no transferred damage. If you see the LABOOMA SKI BOX is compromised by the shipping company, you must make your claim with them directly. The shipping company will resolve any claim directly with you and not US.

Section 5 - Damages visible only during unpacking

If there is no exterior damage visible during delivery and should you discover interior damage during unpacking, you must take photographs for documentation. You must then immediately contact the shipping company and file a claim directly with them. We believe the above will rarely happen as most of the interior components are small and easily protected inside the ABS box.

Section 6 - Shipping Company Contact

While we choose the shipping company on your behalf, technically they are your shipping agent and therefore any contact with them can only be made by you. We will not negotiate shipping or damage issues with any transport company.

Section 7 - Warranty and Guarantee

The LABOOMA SKI BOX is hand assembled in our facility and it will not ship unless it is functioning correctly. There is an elaborate check list during assembly and a sign off is required which assures a high-quality build process. Note the following:

  • The box function of correct opening, closing, and locking is warranted for 180 days and assumes normal usage.
  • Gas shocks are warranted for failure for 180 days and are easily removed for replacement if necessary. Gas shocks submitted for warrantee replacement must be mailed to us, at your cost, for our inspection. The return mailing costs of replacement gas shocks to you is free.
  • If gas shocks fail after the 180-day warrantee period, the cost to replace each will be $10 per piece plus shipping during the first 5 years.
  • If for some reason you must return the LABOOMA SKI BOX to us for needed correction, the cost of the return to us is your responsibility. The shipping cost of the LABOOMA SKI BOX back to you is outlined under RETURNS. This includes, but is not limited to, the cost of shipping and
    the cost of the returned cardboard box.

Section 8 - Local Installation by LLTEK

If you live in the Montreal area (H3P 2H4) or are visiting, you may pick your LABOOMA SKI BOX up at our facility. After your order file has been processed, you need to call or email us to schedule an appointment date and time. You will receive a $40 credit for the not needed cardboard shipping box. We will install the LABOOMA on your car at no cost to you.

Section 9 - Cross Bars and Driving Speeds

We suggest you position the box as far back as possible ensuring your trunk lid can open if an SUV. You will also see the cut out for a whip antenna so position accordingly. You are to use cross bars that meet the approval of the manufacturer of your car. Many cross bars are rated for compatibility with your car, and you must follow their guidelines. The installation of your cross bars and the space between them (max and minimum) are your responsibility. Always follow the guidelines of your car and bar manufacturer. Your car manufacturer will recommend a maximum driving speed for bars with attachment devices installed and you must follow their instructions. Although the LABOOMA SKI BOX is Low Profile especially when compared to Cargo Boxes, maximum driving speeds are specified by the car and bar manufacturer. In the event there are no specific speeds forthcoming from the car and/or bar manufacturer, you must obey local posted government speeds. If there are no posted speeds, you may not exceed 70mph or 100KPH speeds.

Section 10 - LABOOMA SKI BOX Installation

The full responsibility of a correct and safe LABOOMA SKI BOX installation is yours. Use 2 fit adults to lift the box onto the roof of a vehicle to maintain safety. It is not safe to use children to help install the box and during installation children should not be in the general lifting area. There are 4 Super Claws provided and are used to fasten your LABOOMA SKI BOX to your approved cross bars. You may not use other attachment devices. The Super Claw is very strong and made utilizing T304 solid stainless steel. Each has a hard rubber insert to create an extra-strong grip which creates extra safety. The 8 bolts used to hold the Super Claw in place are also made from stainless steel. There are 2 plastic tightening turn knobs (red top) per Super Claw for a total of 8 stainless steel bolts. For each bolt, there is a stainless-steel lock washer to be used under each tightening knob for additional tightening security and safety (total 8 lock washers). It is your responsibility to check the tightening of your 4 knobs on a 30-day basis or sooner if warranted. The box purchaser, family members and passenger friends release all Liability to US and Indemnifies US of any damage created by
incorrect installation. In addition, Liability to us is released when an incorrect installation is made, or if there is failure to follow the provided installation and speed recommendations.

Section 11 - Legal Liability

In the event that any possible Legal Liability arises, the purchaser agrees to proceed only with arbitration resolution and waives the right to any and all court proceedings. Arbitration resolution must be completed in Montreal, Quebec, Canada which is where the LABOOMA SKI BOX was designed and is assembled. Notwithstanding the agreed arbitration, the maximum payment consideration, for any settlement, shall be no greater than $300.00 Canadian Dollars. The purchaser hereby waives any objection to the location of the arbitration city, any inconvenience and possible associated costs, and any settlement amount. If any section is ruled invalid the remaining sections remain valid.

Section 12 - Acceptance Signature

The acceptance of all TERMS as detailed above is deemed automatic when a LABOOMA SKI BOX purchase is made from our website. It is the responsibility of the purchaser to read and acknowledge these TERMS. Virtual acceptance is the equivalent of signing and agreeing to the TERMS document. Although there is only one primary purchaser, the TERMS are deemed to be accepted by family, friends and appointees of the purchaser, and is intended to promote safe usage. If the LABOOMA SKI BOX is gifted or resold to another person or entity, the TERMS acceptance stays in force for the new person or entity.

Section 13 - Hazard and Risk and More

The purchaser understands and accepts that the attachment of any device to a car using cross bars carries risk. Furthermore, the purchaser understands and accepts that an attached container box and more particularly the LABOOMA SKI BOX carries risks. These risks may include but are not limited to bodily harm to the purchaser and/or to others which may be severe and may cause permanent disability or death, if LABOOMA SKI BOX becomes detached while driving. The purchaser of a LABOOMA SKI BOX, accepts all hazards and risks associated with the installation of the LABOOMA SKI BOX. This includes hazards and risks not expressly mentioned in these TERMS. You agree to inspect the installation of the ski box and cross bars on a regular 30-day basis, and more particularly to inspect the Super Claws and adjust accordingly. When locking the LABOOMA SKI BOX you agree to ensure all lock and latch points are engaged prior to driving.

Section 14 - Change in the TERMS Agreement

From time to time the TERMS agreement may be changed and updated without notice to you. Your TERMS agreement is the one you accepted at the time of your purchase and may be somewhat different when compared to the current TERMS agreement. By accessing or using the www.SKIBOXBOX.com website you agree to be bound by the published TERMS at the time of your purchase, and to any subsequent modifications and/or changes to the TERMS.

Section 15 - Authorized individual and Warrants

  • You, the purchaser, warrant when executing a purchase, you have the legal authority and authorized capacity to complete and pay for the transaction amount.
  • You warrant you are 18 years or older.
  • You warrant that you will provide accurate name and billing information for the credit card used during the purchase process.
  • You warrant you will provide all requested data for delivery.

Section 16 - Copyrights and Trademarks

LLTEK Motorsports Corp holds 3 international design patents, trademarks and copyrights for the LABOOMA SKI BOX. Additionally, the LABOOMA name is trademarked protected. LLTEK MOTORSPORTS CORP will vigorously defend any apparent infringement of its rights. The purchaser or its agents and associates agree that they will in no way infringe on these patents, trademarks and copyrights.

Section 17 - Design Changes, Upgrades and Alterations

From time to time the look and attributes of the LABOOMA SKI BOX may change. This includes but is not limited to the replacement position and quantity of various emblems and logos, any change in the color of the physical box, the addition or deletion or omittance of certain graphics, any mechanical changes, and any changes in color to various hardware. Any change may be made without the consent of the purchaser.

The headings used in these Terms and Conditions are for convenience only.
